Meeting was opened with the Pledge of Allegiance and Lord’s Prayer.

A MOTION was made by Mrs. Hamilton, seconded by Mrs. Coy to approve
minutes of August 13, 2007 as written/read.  Motion Carried.

A MOTION was made by Mr. Hostetler seconded by Ms. Schwaderer to
approve

Jeff Pelc of USDA discussed the bird problem we have within the
Village.
It was discussed the birds are here in the evenings starting about
6:00PM
until dark but only on the east side of town.
The birds came in early June which is about 2-3 weeks earlier than in
the
past years.
Mr. Pelc suggested the harassment program with pyrotechnics.
There are three types of pyrotechnics but the most effective in the
Village would be the pistol with (ammo) birds bangers or screamer
sirens.
The pistol is about $60.00 plus the cost of the ammo about $30.00 per
box
of 50.  He said the Village would use about 200-300 rounds a night.
He
assured us this program will work if everyone gets involved, even the
kids can help. Training would be necessary on the pistols to avoid any
injury.
This program may take 1-2 weeks or only 3 days. He said this would be
a
lot of work and communication between the Village and Volunteers to
get
rid of the birds. Mr. Pelc said they can also do the work for $$.
Mayor
Hostetler told the clerk to contact Mr. Pelc in the spring of 2008.
Mrs. Kauffman is concerned with the safety issues of the bird feathers
and feces on the porch and sidewalks. She has called the health
department 3 times and they said it was not dangerous to your health.
Mr. Hostetler asked about setting up a habitat for hawks or owls and
Mr.
Pelc thinks this idea is so unpredictable and its hard to keep the
predators in town.
Mr. Thoman tried to repair/replace his sidewalk and the concrete
business
said they would not touch the sidewalk until the birds were gone.
Clerk will be calling Mr. Pelc in the Spring 2008, because its too
late
this year – the birds will be gone in a few weeks.

Disawin Ballard gave the Council Members a petition wanting an
Ordinance
for Jake Braking.  She in concerned with the foundations of the houses
on
SR 68 and the semis bounce and shake the ground.  She is also
concerned
with the speed coming into town and residents backing out of their
driveways or Wren’s Florist.
Mr. Workman is a retired truck driver and the “jake brakes” are
not
necessary if their speed is in check before they come to town. Chief
Murray will find out what the maximum penalty is for jake braking.
Some suggestions were to post “reduced speed ahead” signs at the
corporation limits.
Mr. Legge will look into this situation.

Choice One Engineering came to inspect the bridge on East Columbus St.
and he will contact someone who can inspect further.  Mr. Legge is
asking
who is responsible for this bridge because it is over the railroad
tracks
and does the Village own it or the railroad. Solicitor Moell will
check
this out.

Mr. Legge informed Council the Village is responsible for the corners
of
streets.  Shane Long installed sidewalk on Tupper and Runkle St. and
Council approved.

Mr. Legge is applying for the OPWC grant for Columbus St. again this
year.
We will approve Resolution next meeting and paperwork needs to be in
by
the end of October.

Mr. Legge is asking to purchase a drinking fountain for the garage in
the
amount of $465.00.
The street guys do not like wearing the vests and would like to
purchase
reflective T-shirts in the amount of $5.00 each with free patch/name
and
Village logo.
These purchases will come out of the scrap metal fund.

Mr. Legge is asking to purchase a diesel fuel tank and let it be used
by
the Fire Department, Water/Sewer departments.  This purchase would be
about $10,000.00 to include fence, tank, pump, etc.
Finance committee will look into this purchase.

Fire Chief Esch discussed with other fire fighters about charging for
the
runs made by the Fire Department. Some concerns were insurance
covering
auto crashes compared to structure fires, false alarms, home security
systems, Green Hills, Trutec, West Liberty High School, and the
Village
processing claims. He said in 2005 the fire department had 208 calls
and
15 runs could have been charged and in 2006 -- 171 runs were made but
14
were structure fires and 9 were field/brush fires.  He suggested if
the
Village needs more money they may need to think about an income tax.

Fire Chief Esch would like to hire one guy one day a week to better
assist on maintaining vehicles at $10.00 - $12.00 an hour. Finance
committee will look into this.

Patrolman Gary Clay was here to announce he will be starting a
neighborhood watch and will be having a meeting at Adriel on September
13, 2007
@ 7:30PM. This is just an informational meeting and to see
how
many residents are interested.

EMS Chief is on a four week leave of absence due to his wife having
surgery.

Kevin Spellman of BWC will be here tomorrow at 9:00 AM for a safety
meeting.
Mayor Hostetler is suggesting we need to have someone who is in charge
of
safety meetings/ issues for the Village.  He will be talking to
someone
who already works for the Village and see if he would be interested.

Clerk Boyd reported seven residents would like the Village to
repair/replace their sidewalk.  Mr. Legge will be contacting concrete
companies to get estimates.

Logan Baptist Church is asking to rent the Community room on Wednesday
for Children’s Church.  Council agreed.

The banner cable broke during the high winds we had this past week.
Rabenstein Electric will be replacing it with extra safety measures in
the amount of $500.00. Council agreed to pay for $250.00.

Chief Murray has sent several letters to enforce property owners to
clean
up their properties.

Solicitor Moell explained the difference between fiscal officer and
Clerk/Treasurer.
The biggest difference would be appointed or hired compared to
elected.
Quincy’s clerk wanted to be hired to send water/sewer bills and keep
the
Clerk’s job.  So they opted to change the position to hired.

The book solicitor Moell wanted to purchase was already here on the
self
so it was not necessary to purchase but we will keep it updated.

Resolution 2007-R1 entitled “A Resolution Employing a Village
Solicitor
for the Village of West Liberty, Logan County, Ohio for a two year
term
beginning January 1, 2007 and ending December 31, 2008, and providing
compensation therefore and declaring an emergency.” There was a
mistake
and needs to be amended – Section 2.  That the monthly salary for
the
position of Solicitor for the Village of West Liberty, Ohio shall be
Six
Thousand Dollars ($6,000.00) … and this should read deleting monthly
“That the salary for the position for the position of Solicitor for
the
Village of West Liberty, Ohio shall be Six Thousand Dollars
($6,000.00)…
A MOTION was made by Mrs. Hamilton seconded by Ms. Schwaderer to
suspend
the rule requiring three separate readings to amend Resolution
2007-R1.
Motion Carried.
A MOTION was made by Mr. Lance seconded by Mr. Hostetler to amend
Resolution 2007-R1 deleting “monthly” in Section 2.   Motion
Carried.

A MOTION was made by Mrs. Coy seconded by Mrs. Hamilton to adjourn at
9:40 PM. Motion carried.
