Present for this regular meeting of the Village of West Liberty Council was: Mayor Hostetler, Mr. Lance, Mr. Hostetler, Mr. Hyland, Mrs. Coy, Ms. Schwaderer, Mrs. Hamilton, Solicitor Moell, Mr. Legge, Chief Murray (8:30PM) and Clerk Boyd. Guests:  Susan Edwards of Bellefontaine Examiner, Matt Strayer of WPKO/WBLL radio. Other guests were: Helen Foughty, Tina Thompson, Spencer Davis, Laura Shiveley, Joseph West, Bev Yoder, Virgina Gregg, Gary Hastings, Robert Allison and Tim Smoot.

 

Meeting was opened with the Pledge of Allegiance and Lord’s Prayer.

 

A MOTION was made by Mr. Hyland, seconded by Mr. Lance to approve minutes of July 9, 2007 as written/read.  Motion Carried.

 

A MOTION was made by Mrs. Hamilton seconded by Mrs. Coy to approve the following bills in the amount of $17,679.94. Motion Carried.

Joshua Goings was sworn in by Mayor Hostetler to be a West Liberty Police Auxiliary Patrol Officer.

Joseph West and Laura Shiveley spoke about the letter they received to repair their sidewalk.  Mr. West gave the Council members Ohio Revised Code Section 5543.10 (B) and 2744.02 (3) and others dealing with shade trees. His concern is the shade tree is pushing up the sidewalk and the Village should trim/remove the shade tree because it’s in the “right-of-way.” Then the sidewalk is a public sidewalk and Village should be responsible for replacing this. 

Solicitor Moell felt the ORC sections that were presented were dealing with Townships not Villages, but he would look into this further and get back with him.

Mrs. Foughty asked why some property owners do not have sidewalk and those who do have to replace them. “The plan of having sidewalks and not having sidewalks was decided a long time ago and we did not have anything to do with that decision” said Mayor Hostetler.

Mayor Hostetler wanted to make it clear we do not have a timeline and we do not want this to be a burden to anyone but we want the Village to be safe.

The Village is not in the business of planting or trimming trees and the big shade trees make the Village unique. 

There is concern with trimming or cutting a tree root from under a sidewalk if the tree would die or fall down at the next big storm.  Clerk Boyd will call the Ohio Extension Office and get their opinion. 

If someone has a special exception for replacing/repairing or tearing out the sidewalk they can talk to Mr. Legge and he can recommend it Council and they will make a decision what would be the safest possibility.

 

Mrs. Foughty is concerned with a home close to her with weeds, trees, trash, etc around and if someone can send a letter to clean up their property.  Chief Murray will take care  of this.

 

Tina Thompson wants to know if there is an alley beside her or is it a driveway.  Mayor will talk to the Zoning Board.

 

Streets are getting paved with Issue II money today and finishing up tomorrow.

 

Mayor Hostetler talked about Robert Griffith resignation.  Mr. Griffith felt with his prison ministry, grandchildren and family he did not feel he was returning phone calls in a timely manner and felt he needed to step down.  The Village denied his resignation.  Mr. Griffith decided to keep the job because he likes his job and he knows the Zoning Ordinance front to back. 

 

Received a quote from LeVan Excavating to install manhole with drain grate on the west side of bridge and patch road and pour concrete around the catch basin at the fire house in the amount of $5140.00 and Yoder Concrete gave a quote of $4898.00. A MOTION was made by Mr. Hyland seconded by Mrs. Coy to allow Yoder concrete to repair/replace to grate at the viaduct on 245 W., catch basin at the firehouse, etc.  Motion Carried.

 

Chief Murray said Josh Goings ordered a bullet proof vest thru DeGraff and asked if we would buy it for him.  Mayor agreed to purchase the vest.

 

Ordinance 2007-09 entitled “AN ORDINANCE TO AMEND THE ANNUAL APPROPRIATION ORDINANCE 2007-03 FOR THE VILLAGE OF WEST LIBERTY, OHIO FOR THE FISCAL YEAR ENDING DECEMBER 31, 2007” was read amending the Brown Fund.  A MOTION was made by Mrs. Coy seconded by Mr. Lance to suspend the rule requiring three separate readings.  Motion Carried.

A MOTION was made by Ms. Schwaderer seconded by Mr. Hyland to adopt Ordinance 2007-09 to amend the Brown Fund.  Motion Carried. Yeas: 6 Nays: 0.

Ordinance 2007-10 entitled “AN ORDINANCE ESTABLISHING THE SALARIES AND WAGES FOR THE EMPLOYEES IN THE VILALGE OF WEST LIBERTY, OHIO AND PROVIDING FOR THE PAYMENT THEREOF” was read.  A MOTION was made by Mr. Lance seconded by Mr. Hostetler to suspend the rule requiring three separate readings.  Motion Carried.

A MOTION was made by Mrs. Coy seconded by Ms. Schwaderer to adopt Ordinance 2007-10 to increase Cemetery Sexton Salary 3%.  Motion Carried. Yeas: 6 Nays: 0.

 

Ordinance 2007-11 entitled “AN ORDINANCE ESTABLISHING THE SALARIES FOR THE VILLAGE OFFICIALS IN THE VILLAGE OF WEST LIBERTY,

OHIO AND PROVIDING FOR THE PAYMENT THEREOF” was read.  A MOTION was made by Mr. Lance seconded by Mr. Hostetler to suspend the rule requiring three separate readings.  Motion Carried.

A MOTION was made by Mrs. Coy seconded by Ms. Schwaderer to adopt Ordinance 2007-11 to increase Clerk Salary starting next term.  Motion Carried. Yeas: 6 Nays:0

 

Resolution 2007-R3 entitled “A RESOLUTION AUTHORIZING THE VILLAGE OF WEST LIBERTY TO ENTER INTO A CONTRACT FOR STREET LIGHTING SERVICES FOR USE ON PUBLIC GROUNDS AND STREETS IN THE VILLAGE OF WEST LIBERTY, LOGAN COUNTY, STATE OF OHIO, FOR A PERIOD OF FORTY-EIGHT (48) MONTHS COMMENCING JANUARY 1, 2008 AND EXPIRING ON DECEMBER 31, 2011” was read. A MOTION was made by Mr. Lance seconded by Ms. Schwaderer to adopt resolution 2007-R3 on third and final reading.  Motion Carried.

Yeas: 6 Nays: 0. 

 

Rules of Council were read. A MOTION was made by Mr. Hyland seconded by Mr. Hostetler to adopt the rules of Council on third and final reading.  Motion Carried.

 

Personnel Policies and Procedures for the Village of West Liberty was read.  A MOTION was made by Ms. Schwaderer seconded by Mr. Hostetler to adopt Personnel Policies and Procedures on third and final reading.  Motion Carried. 

Clerk will make copies and hand them out the employees and sign them.

 

Received a resume from James Strunk to apply for the zoning officer position, which is not open anymore.  Clerk will file it.

 

Ms. Schwaderer will be having surgery tentatively August 12th and be out of commission for a week or more.

 

Clerk will be getting an estimate on installing sidewalk between the cannon and Good Eats and Treats.
