Present for this regular meeting of the Village of West Liberty Council
was: Mayor Hostetler, Mr. Lance, Mr. Hostetler, Mrs. Coy, Mrs. Hamilton,
Solicitor Moell, Mr. Legge, and Clerk Boyd.  Absent: Ms. Schwaderer and
Mr. Hyland excused.  Also present: Fire Chief Esch, Chief Murray.
Guests: Jim Yoder resident and Truck driver and Rebecca Marker-Smith and
Carmean Scott of Simon Kenton Pathfinders.

Meeting was opened with the Pledge of Allegiance and Lord’s Prayer.

A MOTION was made by Mr. Lance, seconded by Mrs. Coy to approve minutes
of September 24, 2007 as written/read.  Motion Carried.

A MOTION was made by Mrs. Hamilton seconded by Mr. Hostetler to approve
the following bills in the amount of $74,258.24. Motion Carried.

Jim Yoder is a local truck driver and travels West Liberty 5-6 days a
week 2-3 times a day. If he did not use his “jake brakes” on a regular
basis he would have to replace his brakes more often and the cost of new
brakes is approximately $3500.00.  The also receives about 2-3 times
mileage using the “jake brakes” than his regular brakes.
The “jake brakes” are used for a purpose. They are to help stop a truck
that weighs about 80,000 lbs.  Mr. Yoder does not use his “jake brakes”
unless necessary in town and would like Council to consider these thought
before implementing this Ordinance.
Chief Murray said if a truck driver had not used his “jake brakes” last
week a pedestrian would have been hit. DeGraff has had nothing but
headaches with their “jake brake” ordinance.  But he also thinks some
drivers have been abusing the “jake brakes” and waiting to get in town to
start slowing down.  Mrs. Coy suggested when the Cemetery is annexed then
we can enforce the speed and it would slow down the truck drivers
earlier, before they get into town. A MOTION was made by Mrs. Coy to
table this decision for now, no one seconded.  A MOTION was made by Mrs.
Hamilton seconded by Mr. Lance to adopt Ordinance 2007-12 on third and
final reading entitled “AN ORDINANCE CONCERNING NOISE PREVENTION AND
PROHIBITING MECHANICAL EXHAUST BRAKING SYSTEMS OR ENGINE RETARDERS
COMMONLY KNOWN AS JAKE-BRAKING AND PROVIDING FOR PENALTIES FOR SUCH
PRACTICE.” Yeas: 3 Nays: 1. Motion Carried.

Solicitor Moell is working on the annexation of the Cemetery.

Rebecca Marker-Smith and Carmean Scott were here to ask Council to pass a
Resolution to support Simon Kenton Pathfinders to extend the walking,
biking, running track through West Liberty to connect Bellefontaine and
Urbana.  When the path is finished it will be extended 90 miles to
Cincinnati.  Council agreed this would be a good idea to bring more
visitors into West Liberty for the Business District. Rebecca
Marker-Smith will be getting the Clerk a sample Resolution to support
Simon Kenton Pathfinders.

Resolution 2007-R10 entitled “A RESOLUTION ADOPTING A POLICY FOR PUBLIC
RECORDS FOR THE VILLAGE OF WEST LIBERTY, LOGAN COUNTY, HIO” was read. A
MOTION was made by Mrs. Coy seconded Mr. Lance to pass on 2nd reading
Resolution 2007-R10.  Motion Carried.

All Council members received a draft copy of the Employee Safety
Handbook.  The safety committee has been working on this for the last few
weeks and if there are any changes come back at the next meeting.  Mr.
Lance thinks this will cover 99% occurrences in the Village.

Fire Chief Esch was here demonstrating a new STOP/SLOW lighted sign for
the fire department.  The cost is $412.95 with the handle purchased from
TMS Technologies.
Council will pay for one of the Stop signs and fire department can pay
for the other one.

Mr. Shane Oelker is asking to be reimbursed $77.35 for a hotel room at
Richfield, Ohio for an Arson Class.  He is trying to get a masters degree
in investigator. A MOTION was made by Mrs. Coy seconded Mr. Hostetler to
pay for Mr. Oelker hotel room. Motion Carried.  Chief Murray needs to
make sure this is asked in advanced next time.

Residents are concerned the warning sirens are being heard on the out
skirts of West Liberty.  The Fire Department applied for a grant for
rotating sirens and the EMA grants are on hold for now but they are still
on the agenda.  Fire Chief will be looking into this.

A MOTION was made by Mr. Lance, seconded by Mr. Hostetler to pass the
Check Writing Policy authorizing the Clerk to write checks up to
$49,999.99 with one signature and $50,000.00 and over will require two
signatures. Motion Carried.
Mayor Hostetler is now on the signature card at P S & L as auditors
required.

Solicitor Moell has copies of Credit card, travel, cell phone policy and
will present them next meeting.

Board of Public Affairs is asking Council to mandate backflow preventors
and the Village is not responsible for back up in basements.  Solicitor
Moell is working on this.

The Village has a new requirement for banners put up on the cables across
SR 68.  The banners can not be more than 30 inches in height.

Council members and Police were concerned with the vendors on SR 68 at
the Autumn Fest this past weekend.  Business Association blocked all the
parking spaces downtown and vendors set up on those parking spaces.  Last
year WLBA blocked W. Baird St. and W. Columbus which was not a problem.
Anyone wanting something like this needs to fill out a parade permit with
the Village first.

Mr. Hostetler said there are several trees needing trimmed and he will
get addresses for next meeting.

Chief Murray would like to see Bradley St. a one way street running South
to North.  Council agrees and Chief will write letters to the residents
and get their opinion.

Mrs. Cunningham is now working full time in Lima at a factory and should
not be paying unemployment any more.

Chief Murray is concerned with the crimes committed within the Village
and he feels he does not have the manpower to control the severity of the
crimes. He is asking to allow the auxiliary to work 48 hrs. instead of 40
hrs. Average monthly calls are 19-25 and this month already they have 35
calls.  Finance Committee will be meeting within the next few weeks to
discuss other issues and this will be one we will be looking at.

Council meeting November 12th is Veterans Day and will be changed to
November 13th Tuesday at 7:30 PM.

A MOTION was made by Mrs. Hamilton seconded by Mr. Hostetler to adjourn
at 9:15 PM.  Motion Carried.
