Present for this regular meeting of the Village of West Liberty Council
was: Mayor Hostetler, Mr. Lance, Mr. Hostetler, Mrs. Coy, Ms. Schwaderer,
Mr. Hyland, Solicitor Moell, Mr. Legge, and Clerk Boyd. Absent: Mrs.
Hamilton (vacation). Also present: Mr. Harrison, Mr. Legge, Chris Jones
and Susan Edwards from Bellefontaine Examiner.
Meeting was opened with the Pledge of Allegiance and Lord’s Prayer.
A MOTION was made by Mrs. Coy, seconded by Mrs. Schwaderer to approve
minutes of August 27, 2007 as written/read. Motion Carried.
A MOTION was made by Mr. Hostetler seconded by Mr. Lance to approve the
following bills in the amount of $49,180.42. Motion Carried.

Mr. Harrison explained the Resolution 2007-R8 to authorize the Chairman
of the Board of Public Affairs to complete an application for $175,000.00
OPWC grant. The wastewater treatment plant needs to comply with the EPA
for a new communitor, to reduce the amount of plastic/cloth, etc. that
gets into the sludge hauled. Mr. Harrison, Mr. Smith, and an engineer of
M & K Engineering is going to Michigan to look at a stainless steel
cleaning bar screen in progress.
A MOTION was made by Mr. Hyland seconded by Mr. Lance to pass on first
reading Resolution 2007-R8 entitled “A RESOLUTION AUTHORIZING THE VILLAGE
OF WEST LIBERTY CHAIRMAN, BOARD OF PUBLIC AFFAIRS TO PREPARE AND SUBMIT
AN APPLICATION TO PARTICIPATE IN THE OHIO PUBLIC WORKS COMMISSION STATE
CAPITAL IMPROVEMENT AND/OR TRANSPORT IMPROVEMENT PROGRAM.” Motion
Carried.
Mr. Legge, Street Superintendent reported if the Village passes an
Ordinance prohibiting Jake Braking, ODOT will come and will put up signs.
Mayor Hostetler will talk to Fire Chief Esch about a tree on S. Taylor
and Runkle St. needing trimmed. Fire Chief Esch also needs to trim his
tree.
We are having a problem with cars parking in the “15 minute” parking
space beside the town hall, and parking all day. Chief Murray will be
notified.
Resolution 2007-R5 entitled “A RESOLUTION TO EMPLOY SURDYK, DOWD, AND
TURNER CO., L.P.A. AS LEGAL COUNSEL FOR THE VILLAGE OF WEST LIBERTY,
OHIO” was read.
A MOTION was made by Mr. Hyland seconded by Mr. Hostetler to suspend the
rule requiring three separate readings. Motion Carried. Yeas: 5 Nays: 0.
A MOTION was made by Mr. Hostetler seconded by Mr. Hyland to adopt

rule requiring three separate readings. Motion Carried. Yeas: 5 Nays: 0.
A MOTION was made by Mr. Lance, seconded by Mr. Hyland to adopt
Resolution 2007-R-6 entitled “RESOLUTION ACCEPTING THE AMOUNTS AND RATES
AS DETERMINED BY THE BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX
LEVIES AND CERTIFTING THEM TO THE COUNTY AUDITOR.” Motion Carried. Yeas:
5 Nays: 0.
Ordinance 2007-12 entitled “AN ORDINANCE CONCERNING NOISE PREVENTION AND
PROHIBITING MECHANICAL EXHAUST BRAKING SYSTEMS OR ENGINE RETARDERS
COMMONLY KNOWN AS JAKE-BRAKING AND PROVIDING FOR PENALTIES FOR SUCH
PRACTICE” was read.
A MOTION was made by Mr. Lance, seconded by Mr. Hostetler to approve
Ordinance 2007-12 on first reading. Motion Carried. Yeas: 4 Nays: 1.
Fire Chief asked, at the last Council meeting, if he could have a
part-time Maintenance/Inspector person one day a week for eight hours to
help with inspections of the fire equipment. Clerk and the Fire Chief
looked at the budget and he would be paid $13.00 hr. for eight hours a
week. It would be close appropriations to do this. But it would only be
about $2000.00 until the end of the year and if the auxiliary doesn’t
spend everything appropriated, it could be used. Tracy Oelker is who he
would like to hire.
Ordinance 2007-13 entitled “AN ORDINANCE ESTABLISHING THE WAGES FOR THE
FIRE DEPARTMENT MAINTENANCE INSPECTOR PART-TIME EMPLOYEE IN THE VILLAGE
OF WEST LIBERTY, OHIO AND PROVIDING FOR THE PAYMENT THEREOF” was read.
A MOTION was made by Mr. Hyland seconded by Mr. Lance to suspend the rule
requiring three separate readings. Motion Carried.
A MOTION was made by Mr. Hyland seconded by Mr. Hostetler to adopt
Ordinance 2007-13 entitled “AN ORDINANCE ESTABLISHING THE WAGES FOR THE
FIRE DEPARTMENT MAINTENANCE INSPECTOR PART-TIME EMPLOYEE IN THE VILLAGE
OF WEST LIBERTY, OHIO AND PROVIDING FOR THE PAYMENT THEREOF.” Motion
Carried. Yeas: 5 Nays: 0.
This is to start Friday September 14, 2007.
The safety Committee, Mayor, and Bob Hughes will be meeting Monday
September 17th to review the Safety Manual.
A MOTION was made by Mr. Hyland seconded by Ms. Schwaderer to adopt the
Safety and Health Policy for Bureau of Workman’s Comp. The employees must
read and sign this policy.
United Methodist Church, on W. Newell St. wants to add on and is asking
to vacate the alley. They will have to meet with the Zoning Officer and
Planning Commission first.
If they agree - a Resolution is passed by Council.
Kevin Spellman of BWC had a meeting with the supervisors, Mayor, etc. and
explained the Village has been dropped from the Group Discount and need
to join the PDP Program. All employees must work together to complete the
paperwork by September 30th. Mayor Hostetler is asking Chris Jones to be
a part-time Safety Officer. Salary was discussed in the amount of $200.00
bi-weekly. Mr. Hyland asked how much this PDP Program would save the
Village? Clerk said $5,000.00.
This is tabled until next meeting.
